Terms of service

Last updated: October 20, 2026

1. Who we are and when these terms apply

The website evieandbear.com ("Evie & Bear", "we", "us") is operated by S Harbers Holding B.V., Mors 11, 7151 MX Eibergen, the Netherlands, Chamber of Commerce (KvK) number 97840882, VAT number NL868255154B01, email info@evieandbear.com. These terms apply to every visit to our website and to every order you place with us. By using our website or placing an order, you agree to these terms.

2. Using our online store

To place an order you must be at least 18 years old, or the age of majority where you live, and able to enter into a binding contract. You agree to give accurate and complete information when you order, and to keep your account details, if you create an account, confidential.

3. Products and availability

We do our best to show our products, colors, prints and sizes as accurately as possible. Colors can look slightly different on different screens, and our size guide is a guide only. All products are offered while stock lasts and some items are available in limited quantities. We may limit the quantity per person, household or order, and we may restrict sales to certain regions. If an item turns out to be unavailable after you've ordered, we'll let you know and refund that item in full.

4. Prices

Prices are shown in the currency of the country you shop from: US dollars (USD) in the United States, British pounds (GBP) in the United Kingdom and Australian dollars (AUD) in Australia. All prices include applicable taxes, such as UK VAT, Australian GST and US sales tax, as well as import duties. Shipping is free. The total shown at checkout is the total you pay. If a price on our website is clearly wrong, we may cancel the order and refund you in full; we'll always contact you first.

5. Placing an order and the contract

Placing an order is an offer to buy the products in your cart. You'll receive an automatic order confirmation by email; this confirms that we received your order. The contract between you and us is formed when we ship your order and send you the shipping confirmation. We may refuse or cancel an order, for example when an item is out of stock, when there is a clear pricing error, or when we suspect fraud. If we cancel, you'll receive a full refund.

6. Payment

You can pay with the payment methods shown at checkout, such as major credit and debit cards, PayPal, Apple Pay, Google Pay and Shop Pay. Payment is taken when you place your order and is processed securely by our payment providers over an encrypted connection; we never see or store your full card details.

7. Shipping and delivery

We ship to the United States, the United Kingdom and Australia. Shipping is free and delivery usually takes 6–12 days (1–2 days processing plus 5–10 days transit). Full details are in our Shipping Policy. Risk of loss passes to you when the parcel is delivered to the address you gave us.

8. Returns, cancellation and refunds

You can return items within 14 days of delivery. Returns are started by contacting our customer service first. You can cancel an order free of charge until it ships. Full details, conditions and costs are in our Refund Policy.

Store credit. When your order ships, you receive 10% of the amount you paid for the items as store credit, valid for 60 days from the day it is issued. Store credit chosen instead of a refund (with 10% extra) never expires. Store credit is linked to your email address, can't be exchanged for cash and is removed for items you return. Full details are in our Refund Policy.

9. Accuracy of information

We try to keep all information on our website correct and up to date, but it may occasionally contain typing errors, inaccuracies or omissions, for example in product descriptions, prices or availability. We may correct these at any time, also after you've placed an order, and will contact you if this affects your order.

10. Intellectual property

All content on this website, including photos, text, logos, illustrations and designs, belongs to Evie & Bear or its licensors and is protected by copyright and other intellectual property rights. You may not copy, reuse or distribute it without our written permission.

11. Prohibited use

You may not use our website for anything unlawful, to infringe the rights of others, to send spam or harmful code, to collect data from the website by automated means, or to interfere with the security or operation of the website.

12. Third-party services and links

Our website may use or link to services and websites of third parties, such as payment providers, carriers and social media. We are not responsible for their content or practices; their own terms and privacy policies apply.

13. Privacy

We handle your personal information as described in our Privacy Policy.

14. Product safety and warranty

Our clothing is made for children; please always follow the care instructions and supervise young children with small parts such as buttons and bows. You have the legal (statutory) warranty rights that apply in your country for goods that are faulty or not as described. See our Refund Policy for how we handle faulty items.

15. Liability

To the extent permitted by law, we are not liable for indirect or consequential loss arising from your use of our website or products. Where our liability cannot be excluded but can be limited, it is limited to replacing the goods, supplying equivalent goods or refunding the purchase price. Nothing in these terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence.

16. Force majeure

We are not responsible for delays or failures caused by events outside our reasonable control, such as natural disasters, strikes, pandemics, carrier or customs disruptions, or failures of public networks. If such an event happens, we'll let you know and do our best to limit the impact.

17. Your consumer rights

Nothing in these terms excludes, restricts or modifies any rights you have under the consumer law of the country you live in, such as the UK Consumer Rights Act 2015, the UK Consumer Contracts Regulations 2013 or the Australian Consumer Law.

18. Reviews, comments and submissions

If you send us reviews, photos, comments or ideas, you confirm that they are your own, truthful and do not infringe anyone's rights, and you allow us to use, edit and publish them in connection with Evie & Bear. We may remove content that is unlawful, offensive or misleading.

19. Indemnification

You agree to compensate us for claims and costs arising from your breach of these terms or of the law, to the extent permitted by the law that applies to you.

20. Termination

These terms apply until ended by you or us. If you breach these terms, we may refuse service or deny you access to our website. Orders already paid for are handled under these terms and our policies.

21. Entire agreement

These terms, together with our Shipping Policy, Refund Policy and Privacy Policy, form the entire agreement between you and us. If we don't enforce a right right away, we can still enforce it later.

22. Severability

If any part of these terms is found invalid or unenforceable, the rest of the terms remain in full force.

23. Governing law and disputes

These terms are governed by the laws of the Netherlands. This does not take away the protection you have under the mandatory consumer laws of your country of delivery: in the United States federal law and the law of your state, in the United Kingdom UK consumer law (including the Consumer Rights Act 2015), and in Australia the Australian Consumer Law. You may bring a claim in the courts of your country. If you have a complaint, please contact us first; we'll do our best to find a solution together.

24. Changes to these terms

We may update these terms from time to time. The version published on our website when you place your order applies to that order.
